These General Terms and Conditions of Sale (GTC) govern sales concluded between:

Hereinafter referred to as “Bijoucolor” or “the Seller”,

Any adult individual acting in a private capacity wishing to make a purchase on the website www.bijoucolor.com, hereinafter referred to as “the Customer”.
ARTICLE 1 – PURPOSE
These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products offered on the website www.bijoucolor.com.
Any order placed implies the Customer’s unconditional acceptance of these GTC.
The Customer declares that they have read and understood these conditions before confirming their order.
The applicable GTC are those in force on the date the order is placed.

ARTICLE 3 – PRODUCTS
Bijoucolor sells, in particular:
- fashion jewellery;
- 925 sterling silver jewellery;
- stainless steel jewellery;
- jewellery featuring natural stones;
- handmade jewellery;
- fashion accessories.
Each product page describes the essential characteristics of the product in accordance with applicable regulations.
Photographs are presented with the utmost care.
However, slight differences in colour may appear depending on the screens used by visitors.
Natural stones, natural materials and handmade products may present slight variations in colour, shape, texture or engraving.
Such variations are inherent to their manufacture and do not constitute a lack of conformity.
ARTICLE 4 – AVAILABILITY
Products are offered subject to availability.
If a product becomes unavailable after the order has been confirmed, Bijoucolor will inform the Customer as soon as possible.
The Customer may then choose:
- a full refund of their order;
- to wait for restocking where possible;
- or an equivalent product subject to their agreement.
Refunds will be made using the same payment method used for the order.
ARTICLE 5 – PRICES
Prices are indicated in euros (€).
They include all applicable taxes (VAT included), excluding delivery charges.
Delivery charges are automatically calculated when the order is confirmed according to:
- the weight;
- the selected carrier;
- the destination country.
For orders shipped outside the European Union, customs duties, import taxes or other charges may be imposed by local authorities.
Such charges remain exclusively payable by the Customer.
Bijoucolor reserves the right to modify its prices at any time.
However, products will be invoiced at the price applicable at the time the order is finally confirmed.
ARTICLE 6 – ORDERS
The Customer freely selects the products they wish to purchase.
Before final confirmation, a complete order summary allows the Customer to check:
- the selected products;
- quantities;
- prices;
- delivery charges;
- delivery details;
- selected payment method.
The Customer may modify or cancel their order until it has been definitively confirmed.
Confirmation of the order constitutes acceptance of these General Terms and Conditions of Sale.
An order confirmation is then sent by email.
Bijoucolor reserves the right to refuse an order in the event of:
- clearly incorrect information;
- previous unpaid amounts;
- fraud or attempted fraud;
- or any legitimate reason provided for by law.
ARTICLE 7 – PAYMENT
Orders must be paid exclusively in euros (€).
The Customer may choose one of the payment methods offered on the website at the time the order is confirmed:
- Bank card (secure payment);
- PayPal;
- Bank cheque (only for orders delivered within mainland France).
In the event of payment by cheque, the order will be registered upon receipt of payment and shipped once the cheque has been cleared.
Bank card payments are processed through a secure payment platform. The Customer’s banking details are never stored by Bijoucolor.
Bijoucolor reserves the right to suspend or cancel any order in the event of payment authorization refusal, non-payment or suspected fraud.
Ownership of the products shall only transfer to the Customer once full payment of the price has been received.
ARTICLE 8 – DELIVERY
Products are delivered to the address provided by the Customer when placing the order.
The Customer is responsible for the accuracy of the information provided. Bijoucolor shall not be held liable for any consequences resulting from an error or omission in the delivery details.
Orders are prepared as quickly as possible after payment confirmation and subject to product availability.
Delivery times indicated on the website are provided for information purposes only. They may vary depending on the destination, the selected carrier or circumstances beyond Bijoucolor’s control.
Delivery charges are automatically calculated during the ordering process according to:
- the weight of the items;
- the selected delivery method;
- the destination.
The delivery methods offered may include, in particular:
- Lettre Suivie (tracked letter service);
- Colissimo;
- Chronopost;
- Mondial Relay.
Depending on the destination or the nature of the products, certain delivery methods may not be available.
In the event of a significant delay, Bijoucolor will inform the Customer as soon as possible and will endeavour to find an appropriate solution.
In accordance with the provisions of the French Consumer Code, if the product is not delivered within the announced timeframe and no amicable solution can be reached, the Customer may request termination of the contract under the conditions provided by law.
ARTICLE 9 – RECEIPT OF THE ORDER
Upon receipt of the parcel, the Customer is advised to check the condition of the packaging as well as the contents of their order.
In the event of any apparent issue (damaged parcel, broken product, missing item or preparation error), the Customer is invited to:
- issue precise reservations with the carrier whenever possible;
- take photographs of the parcel and the products concerned;
- contact Bijoucolor’s customer service as soon as possible, providing any useful supporting information.
These steps help facilitate the processing of the claim and any possible compensation by the carrier. However, they do not affect the Customer’s rights under applicable legal guarantees.
ARTICLE 10 – TRANSFER OF RISKS
The transfer of risks occurs when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the products.
Until such delivery, the risks of loss or damage remain the responsibility of Bijoucolor, in accordance with the provisions of the French Consumer Code.
In the event of loss of the parcel before delivery to the Customer, Bijoucolor undertakes, after verification with the carrier, either to send a replacement order or to refund the order when reshipment is impossible.
ARTICLE 11 – RETENTION OF TITLE
The products remain the property of Bijoucolor until full payment of the price, including all applicable fees and taxes.
This clause does not prevent the transfer of risks under the conditions set out in the previous article.
ARTICLE 12 – FORCE MAJEURE
Bijoucolor shall not be held liable for any failure to perform or delay in performing its obligations where such failure results from an event of force majeure within the meaning of Article 1218 of the French Civil Code.
Events considered as force majeure include, without limitation:
- natural disasters;
- fires;
- floods;
- pandemics;
- industrial disputes;
- administrative decisions;
- interruption of transport or communication networks;
- any external, unforeseeable and unavoidable event preventing the normal performance of contractual obligations.
ARTICLE 13 – RIGHT OF WITHDRAWAL
In accordance with the provisions of the French Consumer Code, consumer Customers have a period of fourteen (14) calendar days from receipt of the products to exercise their right of withdrawal, without having to provide any reason or incur any costs other than the return shipping costs.
To exercise this right, the Customer may send Bijoucolor an unambiguous statement expressing their wish to withdraw, either by post or by email.
The Customer may also use the standard withdrawal form provided for under the French Consumer Code, although its use is not mandatory.
Products must be returned within a maximum period of fourteen (14) days following communication of the withdrawal decision.
Products must be returned:
- complete;
- in their original condition;
- accompanied, where possible, by their original packaging;
- with all possible accessories.
The Customer is only liable for any depreciation of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.
Return costs remain the responsibility of the Customer, unless otherwise provided by law.
Bijoucolor will refund all amounts paid, including standard delivery costs, within a maximum period of fourteen (14) days from receipt of the returned products or proof of shipment, whichever occurs first.
The refund will be made using the same payment method used for the order, unless the Customer expressly agrees otherwise.
ARTICLE 14 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised, in particular, for:
- goods made according to the Customer’s specifications or clearly personalised;
- products unsealed after delivery which cannot be returned for reasons of hygiene or health protection.
As of the date of these GTC, Bijoucolor does not sell personalised jewellery. Should such products be offered in the future, they would fall within the scope of this exception.
ARTICLE 15 – LEGAL GUARANTEES
All products sold by Bijoucolor benefit from the legal guarantees provided for under the French Consumer Code and the French Civil Code.
The Customer benefits in particular from:
- the legal guarantee of conformity;
- the guarantee against hidden defects.
Where a product has a defect covered by a legal guarantee, the Customer may obtain, depending on the circumstances provided by law:
- repair of the product;
- replacement of the product;
- a price reduction;
- or termination of the sale where the legal conditions are met.
Legal guarantees apply independently of any commercial guarantee that may be offered.
ARTICLE 16 – BIJOUCOLOR COMMERCIAL GUARANTEE
In addition to legal guarantees, Bijoucolor provides a commercial guarantee of one (1) year from the date of purchase.
This guarantee covers manufacturing defects identified under normal use of the jewellery.
It does not cover, in particular:
- normal wear and tear;
- scratches;
- natural oxidation of certain metals;
- impacts;
- falls;
- accidental breakage;
- modifications carried out by a third party;
- damage resulting from improper maintenance or misuse.
To preserve the lifespan of jewellery, Bijoucolor particularly recommends:
- avoiding contact with water, seawater, swimming pools or spas;
- avoiding contact with perfumes, cosmetics, solvents and household products;
- removing jewellery before any sporting or manual activity;
- storing jewellery away from humidity when not being worn.
Natural stones, pearls and handmade materials may change over time. Changes resulting from their natural ageing process do not constitute a defect.
ARTICLE 17 – RETURNS AND REFUNDS
Any return request must be submitted to Bijoucolor’s customer service before the products are shipped back.

After receiving and inspecting the returned products, Bijoucolor will inform the Customer whether the return has been accepted.
Where the conditions relating to the right of withdrawal or legal guarantees are met, the refund will be processed as soon as possible and no later than within the period required by applicable regulations.
Refunds will be made using the same payment method used for the order, unless otherwise agreed between the parties.

Bijoucolor endeavours to respond to requests as quickly as possible.
ARTICLE 19 – LIABILITY
Bijoucolor takes the greatest care in presenting and describing the products offered on its website.
Photographs, texts and illustrations are provided for illustrative purposes only. Despite all care taken in their preparation, slight differences in colour, texture or finish may exist between the photographs and the delivered product, in particular due to:
- screen settings;
- the handmade nature of certain jewellery items;
- natural variations in stones and materials.
Such differences do not constitute a lack of conformity.
Bijoucolor shall not be held liable for damage resulting from:
- improper use of products;
- failure to follow care instructions;
- modifications or repairs carried out by a third party;
- normal wear and tear of the product.
In all circumstances, Bijoucolor’s liability is limited to foreseeable direct damages resulting from a breach of its contractual obligations, within the limits permitted by law.
ARTICLE 20 – JEWELLERY CARE
In order to preserve the appearance and lifespan of jewellery, Bijoucolor recommends:
- removing jewellery before showering, bathing or swimming in the sea or a swimming pool;
- avoiding any contact with perfumes, cosmetics, household products and solvents;
- avoiding impacts and repeated friction;
- storing jewellery in a dry place, protected from humidity and direct sunlight.
Natural oxidation of certain metals, changes in natural stones or normal wear resulting from the passage of time do not constitute a manufacturing defect.
ARTICLE 21 – INTELLECTUAL PROPERTY
All elements comprising the website www.bijoucolor.com, including texts, photographs, illustrations, logos, graphics, videos, databases and their presentation, are protected by French intellectual property laws.
Any reproduction, representation, adaptation or exploitation, whether total or partial, without Bijoucolor’s prior written authorization is prohibited and may result in legal proceedings.
ARTICLE 22 – PERSONAL DATA
Bijoucolor collects and processes customers’ personal data solely for the purposes of order management, after-sales service, commercial relations and, where the Customer has given consent, the sending of commercial information.
Data processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and applicable French legislation.
The Customer has, in particular, the following rights:
- right of access;
- right to rectification;
- right to erasure;
- right to restriction of processing;
- right to object;
- right to data portability.

ARTICLE 23 – CONSUMER MEDIATION
In accordance with the provisions of the French Consumer Code, the Customer may make free use of a consumer mediator in order to seek an amicable resolution of a dispute.

The Customer may also use the European Online Dispute Resolution platform where applicable.
ARTICLE 24 – LOYALTY PROGRAMME
Where Bijoucolor offers a loyalty programme, it is exclusively reserved for customers with a customer account.
Loyalty points are awarded according to the conditions specified on the website.
Points:
- have no monetary value;
- cannot be transferred to a third party;
- cannot be exchanged for cash.
Vouchers issued through the loyalty programme are subject to the validity period indicated at the time of issue.
Bijoucolor reserves the right to modify or discontinue its loyalty programme, provided that customers’ acquired rights are respected.
ARTICLE 25 – APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties shall first seek an amicable solution.
If no amicable agreement can be reached, the dispute may be brought before the competent courts in accordance with the rules of the French Consumer Code and the French Code of Civil Procedure.
ARTICLE 26 – ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The Customer acknowledges having read these General Terms and Conditions of Sale before confirming their order.
Confirmation of the order constitutes full and complete acceptance of these GTC.
These General Terms and Conditions of Sale are available at any time on the website www.bijoucolor.com.
They may be downloaded, saved and printed by the Customer.
